These Terms and Conditions (“Terms”) govern your relationship with the LAPP mobile application and the website www.lapptheapp.com (together, the “Service”) operated by Square Mountains, CP Bogerd s.p. (“we”, “us”, or “our”).

 

Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

 

1. Subscriptions and Payments

Some parts of the Service are available only on a subscription basis. Subscriptions are billed and managed exclusively through the Apple App Store.

• Billing cycles are monthly or annual, depending on the plan you select.

• Subscriptions automatically renew under the same conditions unless you cancel them through your App Store account settings.

• A valid Apple ID with a payment method attached is required to purchase and maintain a subscription.

2. Free Trials

From time to time, we may offer free trial periods. Free trial eligibility, duration, and conditions are determined by Apple. If you enter billing information when signing up for a trial, you will not be charged until the trial ends. After the trial period, unless canceled, Apple will charge your chosen payment method for the applicable subscription.

 

3. Payments and Refunds

All payments and refunds are handled exclusively by Apple under the App Store terms and conditions. We do not process payments directly and cannot issue refunds ourselves.

4. Accounts and Security

When creating an account (if applicable), you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

You may not use the Service for unlawful purposes, impersonation, or abuse. You must notify us immediately if you become aware of unauthorized use of your account.

5. Intellectual Property

The Service and all original content, features, and functionality are and will remain the exclusive property of Square Mountains, CP Bogerd s.p. and its licensors.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

 

6. Third-Party Services

The Service may contain links to third-party websites or services. We have no control over, and assume no responsibility for, their content, privacy policies, or practices.

We recommend that you review the terms and conditions and privacy policies of any third-party websites or services you visit.

 

7. Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may also terminate your use of the Service at any time by deleting your account or the app.

 

8. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• the Service will function uninterrupted or error-free,

• defects will be corrected, or

• the Service is free from harmful components.

 

9. Limitation of Liability

To the maximum extent permitted by law, Square Mountains, CP Bogerd s.p. shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service.

 

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Slovenia, without regard to its conflict of law principles.

 

11. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR.

 

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will provide notice within the Service or by other means before the new Terms take effect. Your continued use of the Service after such changes indicates your acceptance of the revised Terms.
